Update: ASG’s Letter Removed

The letter from the Acting Solicitor-General that caused last Friday’s Herald headline has been removed from this site.

    More “transparent” government?

    Given the high public interest in this matter I find it an odd way to go about being open.

    let me see … the letter was obtained as a result of discovery, which means it can’t be used for a collateral purpose.

    Not only that, if you’re engaged in litigation with someone it is poor form to try to litigate that matter outside the courts.

    Right. This in a country where the PM can call people in front of the courts “spys” without them ever even being charged let alone convicted.

    She can tell the media to run with a story she knows is a lie to get rid of someone she doesn’t want and keep quiet when they get taken for defamation.

    Fact is there are no rules anymore. If nothing else this government has made it clear that the only standard is what you can get away with.

    I for one would love to see the rule of law, but that is a long way from where we are right now.

    Good point about the discovery rules Graeme. However, the letter appeared to be, I think, a letter addressed to a litigant in the course of litigation. It is probably a “without prejudice” communication but other than that it has no special protection or confidence (and without prejudice communications are not usually regarded as being confidential)?

    Reminds me of the episode of MASH, where Radar had the Colonel put his initials in the wrong place. The paperwork came back with instructions (through Radar, delivered straightface) that the Colonel “Erase your initials, and then initial your erasures”….which, of course, the Colonel promptly did…!
